– hereinafter referred to as “Provider” –

 



1. Scope of Application

These Terms and Conditions (T&C) apply, once incorporated, to all contracts concluded for the purchase of goods, services or other items (“Goods”) in the online shop under the URL stated above, in the version valid at the time of contract conclusion.


These T&C apply exclusively. Deviating terms and conditions of the customer shall not become part of the contract unless the Provider expressly agrees to them.



2. Conclusion of Contract

2.1 The offers in the online shop constitute a non-binding invitation to visitors to submit a purchase offer for the Goods displayed.

2.2 Orders are placed through the Provider’s online order form. After selecting the desired Goods, entering all required information, and completing all mandatory steps in the checkout process, the customer submits a binding purchase offer by clicking the order button.

A contract is concluded when the Provider accepts the customer’s offer. Acceptance occurs when the Provider

• confirms the order in writing or text form (e.g., by email), or

• ships the ordered Goods and they are received by the customer, or

• requests payment from the customer (e.g., via invoice or credit card charge).

The contract is concluded at the moment the first of these events occurs.

2.3 Before submitting the binding order, the customer may review and correct their entries using standard input methods. All data is also shown again in a confirmation window before the final submission and may be corrected there.

2.4 The Provider will store the contract text after conclusion of the contract and provide it to the customer in text form (e.g., email). No further access to the contract text is provided. If the customer created an account, they may access their order history in the online shop.

2.5 The contract can be concluded in German or English.

 


 

3. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal for off-premises contracts and distance contracts.

A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business, or profession.

Details are provided in the withdrawal policy, which is made available to every consumer no later than immediately before contract conclusion.

 


 

4. Payment and Default

4.1 Prices valid at the time of ordering apply. All prices include statutory VAT and—where applicable—shipping costs. Available payment methods are shown in the online shop.

4.2 If “purchase on account” is agreed, payment is due immediately upon contract conclusion unless otherwise stated in the invoice or checkout.

4.3 If payment by credit or debit card is agreed, the purchase price is due immediately upon contract conclusion.

4.4 If “PayPal” is chosen, payment is due immediately upon contract conclusion. Payment is processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg.

 


 

5. Retention of Title

The purchased Goods remain the property of the Provider until full payment has been received.

 


6. Delivery and Reservation of Self-Supply

6.1 Unless otherwise agreed, delivery is made within the delivery times shown in the online shop to the address provided by the customer.

6.2 Self-collection is not possible.

6.3 If the Provider is unable to deliver the Goods because they were not supplied by their own supplier, despite having placed a binding and timely order, the Provider may withdraw from the contract.

The Provider must inform the customer immediately and refund any payments already made. Mandatory consumer rights remain unaffected.

 


 

7. Warranty

Statutory warranty provisions apply.

 


 

8. Liability and Indemnification

8.1 The Provider is liable without limitation:

• for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty;

• for damages caused by intentional or grossly negligent breach of duty;

• where liability arises from a guarantee;

• for mandatory liability (e.g., under the Product Liability Act).

8.2 In cases of negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical for such contracts, unless unlimited liability applies under section 8.1.


Material contractual obligations are obligations essential to achieving the contract’s purpose and on whose fulfilment the customer may regularly rely.

8.3 In all other cases, liability of the Provider, its representatives, and its agents is excluded.

8.4 The customer indemnifies the Provider against all third-party claims—including statutory legal defence costs—arising from unlawful or contractual breaches by the customer.

 


 

9. Data Protection

The Provider processes customer data confidentially and in compliance with applicable data protection laws. Details are provided in the Provider’s privacy policy.

 


 

10. Final Provisions

10.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), provided that this choice of law does not deprive consumers with habitual residence in the EU of mandatory consumer protection rights in their country of residence.

10.2 If the customer is a merchant, a legal entity under public law, or a public-law special fund, jurisdiction shall lie with the court at the Provider’s registered office unless exclusive jurisdiction applies.

This also applies if the customer has no residence within the EU.

10.3 If any provision of this agreement is or becomes invalid, the remaining provisions remain unaffected.

 


 

11. Online Dispute Resolution / Consumer Dispute Resolution

 

The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
